These Terms and Conditions (“Terms”) govern your access to and use of the website archtransportllc.com (the “Site”) operated by Arch Transport LLC, a licensed motor carrier headquartered at 1727 Bluffview Dr, Dupo, IL 62239 (MC# 667614, DOT# 1460045) (“Arch Transport,” “Company,” “we,” “us,” or “our”). By accessing or using the Site, requesting a quote, or submitting an application, you agree to be bound by these Terms. If you do not agree, please do not use the Site.
1. Use of the Site
You may use the Site only for lawful purposes and in accordance with these Terms. You agree not to use the Site in any way that violates applicable local, state, national, or international law or regulation; to transmit any material that is unlawful, harassing, defamatory, or infringing; to attempt to gain unauthorized access to any portion of the Site, other accounts, or computer systems connected to the Site; or to interfere with or disrupt the operation of the Site or servers/networks connected to it.
2. Quotes, Freight Services, and No Binding Contract via the Site
Information submitted through the Site’s quote request form is a request for information only and does not constitute a binding contract for transportation services. Any actual carriage of goods by Arch Transport is governed by a separate rate confirmation, bill of lading, broker-carrier agreement, or other written agreement executed between Arch Transport and the shipper or broker, along with applicable tariffs and the terms of the Carmack Amendment and other federal transportation law where applicable. Freight rates, availability, and transit estimates provided through the Site are estimates only and are subject to change based on capacity, fuel prices, accessorial charges, and other factors, and are not final until confirmed in writing.
3. Driver and Employment Applications
If you submit a driver or employment application through the Site, you represent that the information you provide is true, accurate, and complete. Submission of an application does not guarantee an offer of employment or contractor engagement. Arch Transport may conduct background checks, motor vehicle record checks, drug and alcohol testing, and other screening as required by FMCSA regulations and applicable law before extending an offer.
4. Intellectual Property
The Site and all content on it, including text, graphics, logos, images, and software, are the property of Arch Transport LLC or its licensors and are protected by copyright, trademark, and other intellectual property laws. You may not copy, reproduce, distribute, modify, or create derivative works from any content on the Site without our prior written consent, except as necessary to view the Site for your own personal or business use.
5. Third-Party Links
The Site may contain links to third-party websites or services that are not owned or controlled by Arch Transport. We are not responsible for the content, privacy practices, or terms of any third-party sites, and inclusion of a link does not imply endorsement.
6. Disclaimers
The Site and all content, quotes, and information provided through it are offered on an “as is” and “as available” basis, without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or secure, or that any information on the Site (including transit times or rate estimates) is complete or accurate.
7. Limitation of Liability
To the fullest extent permitted by applicable law, Arch Transport LLC and its officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of or related to your use of, or inability to use, the Site. Nothing in these Terms limits Arch Transport’s liability for actual freight loss or damage arising under a separately executed bill of lading, rate confirmation, or transportation agreement, which shall be governed by the terms of that agreement and applicable federal transportation law (including the Carmack Amendment, 49 U.S.C. § 14706), and not by these Terms.
8. Indemnification
You agree to indemnify and hold harmless Arch Transport LLC, its officers, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your misuse of the Site or your violation of these Terms.
9. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Illinois, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or your use of the Site shall be subject to the exclusive jurisdiction of the state and federal courts located in Illinois, and you consent to personal jurisdiction in those courts.
10. Changes to These Terms
We may revise these Terms at any time by updating this page. Changes are effective when posted, and your continued use of the Site after changes are posted constitutes your acceptance of the revised Terms. We encourage you to review this page periodically.
11. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
